1. Acceptance of Terms

By accessing or using MyBizPlan™ ("the Platform", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Platform. These Terms constitute a legally binding agreement between you and MyBizPlan (Pty) Ltd, a company registered in South Africa.

2. Description of Service

MyBizPlan™ is an AI-powered business management platform designed for South African entrepreneurs and SMEs. The Platform provides tools for business planning, financial management, compliance tracking, funding acceleration, and related business services.

3. Eligibility

You must be at least 18 years of age and legally capable of entering into binding contracts under South African law to use the Platform. By using the Platform, you represent and warrant that you meet these requirements.

4. Account Registration

To access most features of the Platform, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Notify us immediately of any unauthorised use of your account
• Accept responsibility for all activities that occur under your account

5. Subscription Plans and Payments

MyBizPlan™ offers both free and paid subscription plans. Paid subscriptions are processed through PayFast, a South African payment gateway. By subscribing to a paid plan, you agree to:

• Pay all applicable fees in South African Rand (ZAR) as stated at the time of purchase
• Provide valid payment information and authorise recurring charges
• Our subscription fees are billed monthly in advance
• Cancellations take effect at the end of the current billing period
• No refunds are provided for partial months of service

6. AI-Generated Content Disclaimer

The Platform uses artificial intelligence to generate business plans, financial projections, compliance guidance, and other content. You acknowledge and agree that:

• AI-generated content is provided for informational purposes only and does not constitute professional legal, financial, tax, or accounting advice
• You should consult qualified professionals before making significant business decisions
• We do not guarantee the accuracy, completeness, or fitness for purpose of AI-generated content
• Financial projections and viability scores are estimates only and not guarantees of business performance

7. Acceptable Use

You agree not to use the Platform to:

• Violate any applicable South African or international laws or regulations
• Infringe on the intellectual property rights of others
• Transmit harmful, offensive, or fraudulent content
• Attempt to gain unauthorised access to the Platform or other users' accounts
• Use automated tools to scrape or extract data from the Platform
• Resell or sublicense access to the Platform without our written consent

8. Intellectual Property

The Platform, including all software, content, trademarks, and materials, is owned by MyBizPlan (Pty) Ltd and protected by South African and international intellectual property laws. You retain ownership of the business data and content you input into the Platform. By using the Platform, you grant us a limited licence to process your data to provide the services.

9. Data Protection and Privacy

We process your personal information in accordance with the Protection of Personal Information Act 4 of 2013 (POPIA) and our Privacy Policy. By using the Platform, you consent to the collection and processing of your personal information as described in our Privacy Policy.

10. Limitation of Liability

To the maximum extent permitted by South African law, MyBizPlan (Pty) Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform. Our total liability to you for any claims arising from these Terms shall not exceed the amount you paid to us in the 12 months preceding the claim.

11. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or non-payment. You may cancel your account at any time through the Billing Portal. Upon termination, your right to use the Platform ceases immediately.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Republic of South Africa. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the South African courts. We encourage resolution of disputes through our support channels before initiating legal proceedings.

13. Changes to Terms

We may update these Terms from time to time. We will notify registered users of material changes via email or in-app notification at least 14 days before the changes take effect. Continued use of the Platform after changes take effect constitutes acceptance of the updated Terms.
